1. Definitions

1.1 First party You enter into a contractual relationship with OtakuFans. OtakuFans is subject to the applicable laws of the jurisdiction where it operates.

1.2 Services means the OtakuFans platform, including all features, tools, content, and services made available through the website, applications, and related channels.

1.3 Content includes any text, images, audio, video, and other materials that you upload, submit, input, generate, publish, or otherwise provide through the Services (collectively, "User Content").

2. Account registration and security

2.1 Age restriction You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to access or use the Services. By registering for or using the Services, you represent and warrant that you meet this requirement.

2.2 Account responsibility You are responsible for safeguarding your account, password, and login credentials, and for all activity that occurs under your account.

2.3 Suspension and termination If we determine that you have violated these Terms, applicable laws, or pose a risk, we may suspend, restrict, or permanently terminate your account and access to the Services without prior notice.

• Illegal sexual content
• Non-consensual intimate or explicit imagery of real persons
• Hateful, harassing, fraudulent, or criminal content

3.2 Infringement of rights Infringe any third party's copyright, trademark, rights of publicity, privacy, reputation, or other legal rights.

3.3 Responsibility for uploads You are solely responsible for the source, legality, authorization, and rights to use any images, materials, or other inputs you upload.

3.4 Automated abuse Use bots, scripts, crawlers, API abuse, bulk scraping, reverse engineering, or other means to disrupt the platform, circumvent limits, or attempt to extract model capabilities.

3.5 Distribution restrictions Unless we expressly authorize in writing, content produced using the Services is for your personal viewing and personal use only. You may not publicly distribute, resell, republish, sublicense, or use it for commercial distribution.

4. Intellectual property

4.1 Your content To the extent permitted by applicable law, you retain rights you lawfully hold in your User Content. By using the Services, you grant OtakuFans a non-exclusive, worldwide, royalty-free, revocable, limited license to process, store, copy, and display such content as reasonably necessary to provide, maintain, improve, and operate the Services.

4.2 Our content The Services and all systems, interfaces, software, trademarks, designs, text, images, models, and related intellectual property are owned by OtakuFans or its licensors and protected by law.

5. AI-generated content

5.1 No human review Output is largely produced by automated systems and may not have been reviewed by a person.

5.2 No warranty of accuracy We do not warrant that any output is true, accurate, complete, lawful, fit for a particular purpose, or non-infringing.

5.3 User responsibility You are solely responsible for any consequences of generating, using, storing, sharing, or distributing any content.

6. Disclaimer and limitation of liability

6.1 "As is" basis The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied.

6.2 Limitation of liability To the fullest extent permitted by law, OtakuFans is not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the Services, including lost profits, loss of data, loss of goodwill, or third-party claims.

6.3 Cap on damages Where liability cannot be excluded, OtakuFans' aggregate liability to you shall not exceed the fees you actually paid to us in the twelve (12) months preceding the claim (if any).

7. Modifications to these Terms

We may update these Terms from time to time. For material changes, we will provide notice through the Services, email, or other reasonable means. Your continued use after the effective date constitutes acceptance of the revised Terms.

8. Governing law

These Terms are governed by the laws of the place where OtakuFans is incorporated or operates as the operating entity, excluding its conflict-of-law rules.
